Terms, payments and refunds.
The short version of how we work together. Last updated October 5, 2026.
Who we are
First Pass Data is operated by 3six9 Media Masters LLC, a Texas limited liability company, 3000 S Hulen Street, Suite 124-676, Fort Worth, TX 76109. Contact: hello@firstpassdata.com.
Every job is covered by a statement of work (SOW) we both sign, and a mutual nondisclosure agreement. If anything on this page differs from your signed SOW, your SOW wins.
What you pay
Files are priced per style, by how much work the file needs, and every file gets a written quote before work starts. Pricing is on our Pricing page. Work outside the agreed scope is billed only if you approve it in writing first.
How you pay
We invoice by email. Brands pay Net 30; small vendors pay Net 15, with a 50% deposit on the first file before work begins. Pay by ACH or wire (preferred), by check, or by card through the secure Stripe link on your invoice. Any amount still unpaid after the due date accrues a late fee of 1.5% per month (18% a year), or the maximum allowed by law if lower, until paid.
Refunds and cancellations
- Our mistakes are fixed free. If an item is rejected because of an error we made, we fix it at no charge. That's the remedy for work that doesn't meet a professional standard, rather than a refund.
- Deposits. If you cancel before we start work on your file, your deposit is refunded in full. Once work has started, the deposit is applied to the work done.
- Ending a job. Either of us can end a statement of work with 5 business days' written notice. You pay for work done up to that date.
- Monthly plans are billed monthly in advance, with a 3-month first term, then month to month.
- Prepaid work bank credit lasts 12 months from payment and isn't refundable.
- Rework caused by changes to your data after approval, by missing or incorrect data, or by a buyer's decision is billed at our hourly rate.
To ask about a refund, email hello@firstpassdata.com. Approved card refunds go back to the card you paid with.
Approval and acceptance
You approve the final file before we submit it. After we send the completion report you have 3 business days to tell us about a problem; after that the work is accepted. The retailer decides whether to buy your items: we prepare and submit your data, but we can't guarantee any retailer's decision.
Ownership and confidentiality
Your data is yours, and once paid for, so are the finished files. We keep our own software, tools and methods. Your information is confidential under our nondisclosure agreement; see our Privacy page for how it's kept and deleted.
Limits and law
Our total liability for a job is limited to the fees for that job, and neither of us is liable for indirect losses such as lost sales. These terms and our agreements are governed by Texas law, with venue in Tarrant County, Texas.
